1. Acceptance of Terms

By accessing or using Glowup ("Service"), operated by Sliiick Inc. ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Glowup provides AI-powered services that generate enhanced photos and written content. Our Service uses artificial intelligence to create images based on reference photos you provide, along with profile content and captions. Generated content may be used for social media profiles, professional headshots, creative projects, and other personal uses.

3. Eligibility

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials, including any API keys, and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

5. User Content and Photos

By uploading reference photos to our Service, you:

Represent that you have the right to use and authorize us to use such photos
Confirm that the photos are of yourself and not of any other person (unless you have explicit written consent from that person)
Grant us a limited license to use such photos solely for the purpose of generating content for your use
Acknowledge that AI-generated images may vary from your actual appearance

6. AI-Generated Content & Likeness Disclaimer

IMPORTANT: You understand and acknowledge that:

All images and content generated by our Service are created using artificial intelligence
NO GUARANTEE OF LIKENESS: Glowup makes absolutely no guarantee that AI-generated photos will accurately represent your actual appearance or resemble you. AI technology has inherent limitations in replicating human likeness, and results vary significantly between generations.
VARIABILITY IN RESULTS: Each generation may produce different results, even with the same reference photos. Some images may closely resemble you while others may not. This variability is an inherent characteristic of AI image generation technology.
RECOMMENDED APPROACH: We strongly recommend generating multiple images and selecting only those that you feel best represent you. Not all generated images will be suitable for use.
Generated content may contain inaccuracies, unintended variations, or artistic interpretations that differ from your actual appearance
You are solely responsible for reviewing, evaluating, and approving any generated content before use
Glowup and Sliiick Inc. are not liable if generated images do not meet your expectations regarding likeness or quality

BY USING OUR SERVICE, YOU ACKNOWLEDGE THAT AI-GENERATED PHOTOS MAY NOT LOOK LIKE YOU AND THAT YOU ACCEPT THIS RISK. CREDITS SPENT ON GENERATIONS THAT DO NOT RESEMBLE YOU ARE NOT REFUNDABLE.

7. Third-Party Platform Compliance Disclaimer

IMPORTANT: By using our Service, you expressly acknowledge and agree that:

Platform Terms: Third-party applications and social media platforms have their own terms of service and policies regarding the use of photos and profile content. It is YOUR sole responsibility to review and comply with these terms.
Photo Verification: Many applications employ photo verification systems to authenticate user photos. AI-generated images may not pass these verification processes. GLOWUP MAKES NO GUARANTEE THAT AI-GENERATED PHOTOS WILL PASS ANY VERIFICATION SYSTEM.
Account Actions: Glowup and Sliiick Inc. expressly disclaim any and all liability for any actions taken by third-party platforms, including but not limited to: account warnings, account suspensions, account bans, shadowbans, reduced visibility, or permanent termination of your account on any application.
Terms Violations: If your use of AI-generated content violates the terms of service of any third-party platform, YOU ASSUME ALL RESPONSIBILITY AND LIABILITY for such violations.
Failed Verifications: Glowup and Sliiick Inc. shall not be liable for any failed photo verification attempts, rejected photos, or any negative consequences resulting from the use of AI-generated photos in verification processes.

BY USING OUR SERVICE, YOU RELEASE GLOWUP, SLIIICK INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES FROM ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, AND CAUSES OF ACTION ARISING FROM OR RELATED TO YOUR USE OF AI-GENERATED CONTENT ON THIRD-PARTY PLATFORMS.

8. Bundles, Permissions & Image Rights

CRITICAL: Our Service allows you to create "bundles" containing reference photos and settings. Bundles may be Personal Bundles (containing your own photos) or bundles containing photos of others with their consent. By creating and/or sharing bundles, you acknowledge and agree:

8.1 Personal Bundles

DEFINITION: A "Personal Bundle" is a bundle containing reference photos of yourself that you create for your own use or to share with others.
YOUR LIKENESS, YOUR RESPONSIBILITY: When you create a Personal Bundle, you are providing your likeness to be used for AI photo generation. You acknowledge that anyone with access to your bundle can generate AI images depicting you.
PERMANENCE OF GENERATED CONTENT: AI images generated from your Personal Bundle become the property of the generating user. You cannot control, recall, or delete images generated by others using your bundle.
NO EXPECTATION OF CONTROL: Once you share a Personal Bundle, you relinquish control over how the recipient uses your likeness. This includes potential uses you may not anticipate or approve of.

8.2 Bundle Permissions & Recipient Rights

WHAT RECIPIENTS CAN DO: When you share a bundle, the recipient can: view all reference photos in the bundle, generate unlimited AI images using those photos, download and use generated images, and apply any available generation styles or prompts.
WHAT RECIPIENTS CANNOT DO: Recipients cannot: download the original reference photos directly, re-share the bundle with other users, or modify the bundle settings.
ACCESS REVOCATION: You may revoke bundle access at any time. However, revocation only prevents future generations—it does NOT delete any images already generated, downloaded, or shared by the recipient.
NO MONITORING: Glowup does not monitor how recipients use bundles or generated content. We have no visibility into or control over recipient behavior.

8.3 Sharing Bundles with Others

YOUR SOLE RESPONSIBILITY: When you share a bundle, you are solely responsible for who receives access and how they use it. Glowup and Sliiick Inc. bear no responsibility for any misuse, unauthorized use, or distribution of your images by third parties.
CONSENT FOR THIRD-PARTY PHOTOS: If you share a bundle containing photos of another person, YOU represent and warrant that you have obtained explicit, informed, written consent from that person. You agree to hold Glowup and Sliiick Inc. completely harmless from any claims arising from lack of proper consent.
NO PRIVACY GUARANTEE: Once you share a bundle, Glowup cannot guarantee the privacy or security of the images. The recipient may use those images to generate AI photos in any manner they choose.
TRUST REQUIREMENT: Only share bundles with individuals you know and trust. Glowup is not responsible for verifying the identity or intentions of bundle recipients.

8.4 Liability & Indemnification for Bundles

DEEPFAKES AND MISUSE: Glowup and Sliiick Inc. expressly disclaim all liability for any deepfakes, manipulated images, harassment, defamation, non-consensual intimate imagery, or other harmful uses of shared bundle content by any party.
RIGHT OF PUBLICITY WAIVER: You waive any claims against Glowup and Sliiick Inc. related to right of publicity, likeness rights, or personality rights arising from the use of your shared bundles by other users.
FULL INDEMNIFICATION: You agree to indemnify, defend, and hold harmless Glowup, Sliiick Inc., and all affiliated parties from any claims, damages, lawsuits, or liability arising from your creation, sharing, or use of bundles.

BY CREATING OR SHARING BUNDLES, YOU ACCEPT ALL RISKS ASSOCIATED WITH OTHERS HAVING ACCESS TO YOUR IMAGES. YOU UNDERSTAND THAT GENERATED CONTENT CANNOT BE RECALLED AND YOU RELEASE GLOWUP AND SLIIICK INC. FROM ALL LIABILITY RELATED TO BUNDLE USAGE.

9. API Access (Glowup Pro Only)

API access is available exclusively to Glowup Pro subscribers. By using the Glowup API, you agree to the following additional terms:

PRO SUBSCRIPTION REQUIRED: API access is a premium feature available only to active Glowup Pro subscribers. Your API keys will be deactivated if your Pro subscription lapses or is terminated.
API KEY SECURITY: You are solely responsible for keeping your API keys confidential and secure. Any actions taken using your API keys are your responsibility. You must immediately report any suspected compromise of your API keys.
USAGE LIMITATIONS: API usage consumes credits from your account. You are responsible for monitoring your usage and ensuring sufficient credit balance. API access may be rate-limited or suspended for excessive or abusive use.
NO SLA GUARANTEE: Glowup does not guarantee any specific uptime, response time, or service level for API access. The API is provided "as is" without warranty.
PROHIBITED API USES: You may not use the API to create services that compete with Glowup, resell API access, or build applications that violate our Terms of Service. You may not use the API to process images of individuals without their consent.
EXTERNAL PLATFORM INTEGRATION: You may integrate the Glowup API with external platforms for your personal or business use. However, you remain bound by all Terms of Service and are responsible for ensuring compliance with these terms in any integrated application.
TERMINATION: We reserve the right to revoke API access at any time for violation of these terms, suspected abuse, or at our sole discretion.

10. Payment and Refunds

All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. All sales are final. Due to the nature of AI-generated digital content, we do not offer refunds once content has been generated. Credits purchased are non-transferable and non-refundable. Glowup Pro subscription fees are billed monthly and are non-refundable for partial months.

11. Self-Image Requirement & Consent

IMPORTANT: By using our Service, you agree to the following:

PHOTOS OF YOURSELF ONLY (Default): Unless using the bundle sharing feature with proper consent, you agree to only upload reference photos of yourself and to only generate AI photos depicting yourself.
CONSENT FOR OTHERS: If you upload photos of another person or use a shared bundle containing another person's photos, YOU represent and warrant that you have obtained explicit, written, informed consent from that person. You agree to provide proof of consent upon request.
NO IMPERSONATION: Using our Service to create images of other people without their explicit consent, or to impersonate any person, is strictly prohibited and may constitute fraud or identity theft under applicable laws.
ACCOUNT TERMINATION: Violation of this policy will result in immediate termination of your account without refund, and may be reported to appropriate authorities.
INDEMNIFICATION FOR CONSENT VIOLATIONS: You agree to fully indemnify, defend, and hold harmless Glowup, Sliiick Inc., and all affiliated parties from any claims, lawsuits, damages, or liabilities arising from your failure to obtain proper consent before uploading or using photos of any individual.

BY USING OUR SERVICE, YOU CONFIRM THAT YOU HAVE PROPER LEGAL AUTHORITY AND CONSENT FOR ALL PHOTOS YOU UPLOAD AND ALL GENERATED CONTENT.

12. Prohibited Uses

You agree not to:

Upload photos of anyone without their explicit consent
Generate images of anyone without their explicit consent
Create deepfakes, non-consensual intimate imagery, or other harmful content
Use the Service for any illegal or unauthorized purpose
Create content that is defamatory, obscene, or otherwise objectionable
Use the Service to harass, stalk, threaten, or harm any individual
Attempt to reverse engineer or compromise the security of our Service
Resell, redistribute, or commercially exploit generated content without authorization
Use generated content for fraudulent or deceptive purposes
Use the API to build competing services or resell API access

13. Intellectual Property

Upon payment, you receive a personal, non-exclusive license to use the AI-generated content for your personal and commercial purposes. Glowup and Sliiick Inc. retain all rights to the underlying AI technology and systems used to generate content.

14. Copyright & Trademark Disclaimer

IMPORTANT: By using our Service, you acknowledge and agree that:

YOUR RESPONSIBILITY: You are solely responsible for ensuring that any content you create, upload, or generate using our Service does not infringe upon any third-party copyrights, trademarks, trade dress, patents, or other intellectual property rights.
NO INFRINGEMENT CHECKS: Glowup does not verify, monitor, or screen generated content for potential intellectual property infringement. Our AI systems may inadvertently generate content that resembles copyrighted material, trademarked logos, brand elements, or other protected intellectual property.
BRAND AND LOGO USAGE: If you use our Service to generate images containing logos, brand names, product designs, or other trademarked elements, YOU are solely responsible for ensuring you have proper authorization or that your use constitutes fair use under applicable law.
NO LEGAL ADVICE: Glowup does not provide legal advice regarding copyright, trademark, or intellectual property matters. You should consult with a qualified attorney if you have questions about the legality of your intended use.
DMCA COMPLIANCE: We will respond to valid Digital Millennium Copyright Act (DMCA) takedown notices. If your generated content is alleged to infringe third-party rights, we may remove it without prior notice.

BY USING OUR SERVICE, YOU ACCEPT FULL LIABILITY FOR ANY COPYRIGHT, TRADEMARK, OR INTELLECTUAL PROPERTY INFRINGEMENT ARISING FROM YOUR USE OF GENERATED CONTENT. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS GLOWUP AND SLIIICK INC. FROM ANY CLAIMS, DAMAGES, OR LEGAL FEES ARISING FROM SUCH INFRINGEMENT.

15. Comprehensive Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING. WE DO NOT WARRANT THAT:

The Service will be uninterrupted, secure, or error-free
AI-generated content will meet your specific requirements or expectations
Generated images will accurately represent any person's likeness
The Service will be compatible with any third-party platform
Any defects or errors will be corrected

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. GLOWUP AND SLIIICK INC. DISCLAIM ALL LIABILITY FOR ANY HARM ARISING FROM YOUR USE OF THE SERVICE OR YOUR RELIANCE ON AI-GENERATED CONTENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOWUP AND SLIIICK INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, data, use, or goodwill
Emotional distress or reputational harm
Any damages arising from bundle sharing or third-party use of your images
Any damages arising from unauthorized access to your account or API keys
Any damages arising from third-party platform actions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO GLOWUP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

17. Comprehensive Indemnification

You agree to indemnify, defend, and hold harmless Glowup, Sliiick Inc., and their respective officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including privacy, publicity, or intellectual property rights
Your use of the bundle sharing feature
Your use of the API
Any claims by third parties whose images were uploaded or generated without proper consent
Any content you create, share, or distribute using the Service
Your violation of any applicable laws or regulations

THIS INDEMNIFICATION OBLIGATION SHALL SURVIVE THE TERMINATION OF YOUR ACCOUNT AND THESE TERMS.

18. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your API keys will be immediately revoked.

19. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

20. Communications

By creating an account and using our Service, you expressly consent to receive communications from Glowup, including but not limited to:

Transactional emails (account confirmations, password resets, purchase receipts)
Service-related notifications (generation completions, account updates)
Product updates and new feature announcements
Promotional offers and marketing communications
Tips and suggestions for improving your content

You may opt out of promotional and marketing communications at any time by clicking the "unsubscribe" link in any email. However, you may not opt out of transactional or service-related communications necessary for the operation of your account.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

22. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
